Tuberculosis Control Laws and Policies: A Handbook for Public Health and Legal Practitioners

This monograph provides information for use by tribal, state, and local public health practitioners and their legal counsel to help improve their understanding and use of relevant laws to respond to challenges concerning TB control. Part I of the monograph contains an introduction and table listing resources on communicable disease and TB control methods in selected US jurisdictions. Part II presents a brief overview of some of the essential components of TB control, including a discussion of the international and national threats of the disease and modern public health interventions. Part III defines public health law and discusses the basic legal framework for communicable disease control for public health practitioners and others without legal training. Part IV examines traditional and modern communicable disease control laws, and Part V focuses on express TB control laws in selected state and local jurisdictions. Part VI addresses illustrative issues in law concerning TB prevention among vulnerable populations, discrimination against persons with TB, immigration and removal of undocumented persons with TB disease, and interjurisdictional coordination of TB control. Part VII provides a checklist for tribal, state, and local TB control laws as a tool to facilitate jurisdictional-specific assessments of relevant legal authorities in support of comprehensive TB control programs.
